This overtime wage class action lawsuit was filed on December 26, 2001, on behalf of current and former Small Business Bankers and Business Banking Officers in California. The complaint alleges that US Bank misclassified its employees as exempt from overtime pay: under California law, employees who spend the majority of their time at work performing "non-managerial" duties are entitled to overtime pay even if they are paid on salary or hold the title of manager.

The Final Judgment and Statement of Decision for Phase II (Damages Phase) have been entered. Both documents are posted below if you wish to review them.

The hearing for the Motion on Attorneys Fees is currently scheduled for February 25, 2010.

US Bank has filed their Notice of Appeal and their opening brief is currently due in January 2010.
