The case covers both Consultants and Senior Consultants in Protiviti’s three lines of service: Technology, Business Risk, and Internal Audit. The case alleges that these employees were improperly and illegally misclassified under California law as exempt employees when in fact they were nonexempt employees and therefore are entitled to overtime compensation and other derivative claims.
The case was certified as a class action by Judge Minning on February 5, 2009. A copy of the order is posted below for your review.
